Terms of Use
These terms govern your use of luxtindustries.com. They are not the contract for a project — that is a separate document we sign with you. Where the two differ, the signed contract wins.
1. Who we are
This site is operated by Luxt Industries, a web design and development studio based in the Philippines ("we", "us"). Reach us at [email protected].
Operator: complete before publishing. Insert your registered business name, registration number and registered address here, matching what you put in the Privacy Policy.
2. Prices shown here are estimates, not offers
Package prices on this site are starting prices, shown in Philippine pesos, for the scope described beside them. They are an invitation for you to get in touch — not a binding offer, not a quote, and not a price we are contractually held to.
- The price for your project depends on its actual scope, and is fixed only in a written quote or signed contract.
- Published prices may change at any time without notice. The price that binds us is the one in your quote.
- Unless a quote says otherwise, prices exclude taxes, third-party costs such as domains, hosting, fonts, stock media and plugin licences, and any work outside the agreed scope.
3. Timelines and responses
We aim to answer inquiries within one business day, and we describe project stages to give you a realistic shape of the work. These are targets and estimates, not guarantees. Delivery dates become commitments only when written into a signed contract, and they assume you supply content, feedback and approvals when we ask for them.
4. No guarantee of results
We describe services including search engine optimisation, performance work and analytics. Results from this kind of work depend on your market, your competitors, your content and the policies of third parties we do not control — search engines above all.
We do not promise any particular search ranking, traffic level, conversion rate, revenue or business outcome, and nothing on this site should be read as such a promise. Case studies and examples of past work show what happened for one client; they are not a prediction of what will happen for you.
5. The site is provided as it is
We work to keep this site accurate and available, but we provide it "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, timely, secure or error-free.
Nothing on this site is professional, legal, financial or technical advice on which you should act without talking to us or another qualified adviser about your own circumstances.
6. Limitation of liability
To the fullest extent permitted by Philippine law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data, lost business or loss of goodwill, arising out of or connected with your use of this site — whether the claim is framed in contract, tort, negligence or otherwise, and even if we were told such damages were possible.
Where liability cannot lawfully be excluded, our total aggregate liability arising from your use of this site is limited to one thousand Philippine pesos (₱1,000.00).
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law — including liability for fraud, for wilful misconduct, for gross negligence, or for death or personal injury caused by negligence. If you are a consumer, these terms do not affect your statutory rights under the Philippine Consumer Act (Republic Act No. 7394) or equivalent law where you live.
7. Intellectual property
The design, code, text, logos and marks on this site belong to Luxt Industries or to the parties who licensed them to us, and are protected by the Intellectual Property Code of the Philippines (Republic Act No. 8293) and international copyright law. You may view and print pages for your own reference. You may not copy, republish, sell or adapt any part of the site, or use our name or logo, without our written permission.
Client names, logos and project images shown as past work remain the property of their owners and appear with permission, as an illustration of our work rather than as an endorsement of you.
Ownership of work we make for you is governed by your project contract, not by this page. As a rule, rights in the final deliverables pass to you on full payment, while our underlying tools, libraries and know-how remain ours.
8. Acceptable use
You agree not to:
- use the contact form to send unsolicited advertising, chain messages or anything unlawful, defamatory, harassing or obscene;
- submit anyone else's personal data without their permission, or impersonate another person;
- attempt to gain unauthorised access to the site, its administrative areas, its APIs or its underlying infrastructure;
- probe, scan, overload or disrupt the site, or circumvent its rate limits or bot protection;
- scrape or harvest the site by automated means beyond ordinary, well-behaved search engine indexing.
We may block access, without notice, to anyone who does any of these.
9. What you send us
If you send us an inquiry, an idea, a brief or feedback, you confirm you are entitled to share it and that it does not infringe anyone's rights. We handle what you send in line with our Privacy Policy.
Please do not send us confidential information through the contact form. Until we sign a non-disclosure agreement, we cannot treat an unsolicited message as confidential — though we will not publish it or pass it to anyone outside the providers listed in the Privacy Policy.
Ideas are not protectable in the abstract, and we work across many clients in overlapping industries. Sending us a suggestion does not entitle you to payment if we independently do something similar.
10. Third-party links and services
This site links to, and depends on, services we do not control — Cloudflare, Upstash and Discord among them. We are not responsible for their content, availability or practices, and a link is not an endorsement. Your use of a third-party site is governed by that site's own terms.
11. Privacy
Our Privacy Policy forms part of these terms and explains how we handle personal data.
12. Changes
We may update these terms. The version in force is the one published here when you use the site, and the date at the top tells you when it last changed. Continuing to use the site after a change means you accept the revised terms.
13. Governing law and venue
These terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-laws rules. Any dispute arising from them or from your use of this site shall be brought exclusively before the proper courts of the Philippines, and you consent to the jurisdiction of those courts. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory rules of your own country.
14. Severability and waiver
If any provision of these terms is held unenforceable, it is to be read down as far as necessary to be enforceable, or severed if it cannot be, and the rest remains in full force. Our failure to enforce a provision is not a waiver of it.
